A Sioux Falls man has been sentenced to 18 months in federal prison for escape, according to an announcement from U.S. Attorney Ron Parsons. Chief Judge Roberto A. Lange of the U.S. District Court handed down the sentence on February 2, 2026.
Timothy Joseph Cervantez, age 25, received a sentence of one year and six months in federal prison. He will also serve three years of supervised release and must pay a $100 special assessment to the Federal Crime Victims Fund.
Cervantez was indicted by a federal grand jury in October 2025 on charges of escape and pleaded guilty on December 15, 2025.
The conviction stems from Cervantez’s previous sentencing in 2024 for possession of a firearm by a prohibited person, which resulted in a term of 33 months with the Bureau of Prisons. Part of that sentence was served at a residential reentry center in Sioux Falls. On September 23, 2025, Cervantez left the center without permission and did not return voluntarily.
“This case was investigated by the U.S. Marshals Service,” the release stated. “Supervisory Assistant U.S. Attorney Connie Larson prosecuted the case.”
Cervantez has been remanded to the custody of the U.S. Marshals Service to serve his sentence.
